On unincorporated land the county's published permit is for development in the floodplain: anyone building, grading, excavating, drilling or building a driveway in the floodplain needs a permit from the floodplain administrator. We found no separate county residential building permit published, so we confirm current requirements at the courthouse before design. Tahlequah and other towns issue their own building permits inside their limits.

The Cherokee County Emergency Management Director serves as floodplain administrator for the county, and anyone planning building construction, excavating, grading, drilling, road or driveway construction, or equipment storage in the floodplain must have a permit (county emergency management page, read 26 September 2026).

The Tahlequah Municipal Airport Zoning Ordinance (adopted 8 July 1997) creates height limit zones within 14,000 feet of the runway that reach certain unincorporated areas of the county. A Height Zoning Conformity Permit is generally needed only for structures over 75 feet, or where terrain would push a structure above a zone's limit.

For a rural septic system, the Oklahoma Department of Environmental Quality requires a soil profile test by DEQ or a DEQ-certified soil profiler, and states that percolation tests may not be performed in scenic river corridors or water body protection areas. DEQ issues the Authorization to Construct before installation.
